Defining a Michigan Wrongful Death Accident
The death of a loved one is always hard to comprehend, but it is especially difficult if you know that the loss could have been prevented and resulted in a Michigan wrongful death accident. Wrongful death is defined as a death that results from a wrongful or a negligent act of another person.
Unfortunately, some of the most common wrongful death accidents in Michigan occur at the hospital, in the emergency room, labor and delivery room, or the operating room. People typically go to a hospital because they trust and rely on the doctors' expertise. As we know, nurses, surgeons, doctors, anesthesiologists, pharmacists and other medical professionals undergo years of education to be able to diagnose and treat medical problems properly.
Although these medical professionals have the training to diagnose and treat injuries, they also have been known to fail while performing medical care. Sadly, when doctor negligence, emergency room negligence, or hospital negligence occurs in Michigan, serious injuries or wrongful death may occur.
A report called "To Err is Human," released by the Institute of Medicine in 1999 showed that up to 98,000 people died in American hospitals that year due to medical mistakes. This was the last report ordered by the federal government, but it is believed that deaths from medical errors have increased through the years.
There are significant emotional and financial consequences if a family member has died from a physician's mistake, hospital neglect or medical malpractice in Michigan. Even if your baby died during delivery or shortly after birth from a skull fracture, forced extraction, or damage caused by delivery instruments, hospitals and doctors in Michigan can be held liable for their negligence.
